Terms and Conditions

Conditions Governing All Users of Services

The Services are available only to Users:

• Who are human (not bots, except for certain authorized API users) and 18 years of age or older.
• Who submit truthful and accurate information about themselves and maintain the accuracy of such information.
• Who do not impersonate any other person or entity or otherwise misrepresent their identity in a profile or elsewhere on the Site.
• With a valid email address.
• Who does not authorize others to use their contact information?

You acknowledge that portions of the NLD  Site are publicly available or available to other Users and may be accessible by syndication programs (including data feed tools), search engines, metasearch tools, crawlers, metacrawlers, and other similar programs.

General Acceptance

Any applications submitted electronically shall have the same force and effect as if the application bore an inked original signature(s). The above information, together with any accompanying financial statements, schedules, or other materials, is submitted for the purpose of obtaining credit and is warranted to be true, correct, and complete.

US Patriot Act:

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person and business that seeks a business loan. What this means for you: When you apply for a loan, we will ask for your business name, address, and Tax Identification Number. We will also ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.

For Loan/Merchant Services:

The Merchant and Owner(s)/Officer(s) identified in the application (individually, an “Applicant”) each represents, acknowledges, and agree that (1) all information and documents provided to NextLevel Dentists, LLC. / ("We", “NLD ”) including credit card processor statements are true, accurate and complete, (2) Applicant will immediately notify NLD of any change in such information or financial condition, (3) Applicant authorizes NLD  to disclose all information and documents that NLD  may obtain including credit reports to other persons or entities (collectively, “Assignees”) that may be involved with or acquire commercial loans having daily repayment features and/or Merchant Cash Advance transactions, including without limitation the application therefore (collectively, “Transactions”) and each Assignee is authorized to use such information and documents, and share such information and documents with other Assignees, in connection with potential Transactions, (4) each Assignee will rely upon the accuracy and completeness of such information and documents, (5) NLD , Assignees, and each of their representatives, successors, assigns and designees (collectively, “Recipients”) are authorized to request and receive any investigative reports, credit reports, statements from creditors or financial institutions, verification of information, or any other information that a Recipient deems necessary, (6) Applicant waives and releases any claims against Recipients and any information-providers arising from any act or omission relating to the requesting, receiving or release of information, and (7) each Owner/Officer represents that he or she is authorized to sign this form on behalf of Merchant. (8) I consent to receive direct mail, faxes, text messages, and e-mails sent by NLD and its affiliates, and subsidiaries, for the purposes of transmitting account updates, requests for information, and notices, and (9) this request is for business and not for consumer purposes.

Trademarks; Copyrights; Proprietary Rights

NLD  owns the visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, and all other elements and components of the NLD Site ("Agency Content" and its other affiliated, subsidiaries, and connected Websites and Landing Pages).

NLD owns the copyrights, trademarks, service marks, trade names, and other intellectual property and proprietary rights throughout the world associated with NLD Agency Content and the NLD  Site.

Users may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of the Agency Content in whole or in part except as expressly authorized in writing by NLD.  NLD  does not grant any express or implied rights in NLD Content to Users, and all rights in and to the NLD  Sites and to its Agency's Content are retained and reserved by NLD.

Agency Warranties and Limitations

NLD  provides the Site "as-is". The agency provides no express warranties, guarantees, or conditions related to the NLD Site. To the extent permitted by law, NLD  disclaims any implied warranties including those of merchantability, fitness for a particular purpose, workmanlike effort, and non-infringement, and including those arising by usage of trade, course of dealing, or course of performance. Without limiting the generality of the foregoing, Agency does not warrant that the NLPF Site will be accurate, error-free, virus-free, or uninterrupted or that it will meet any specific requirements of a User. Users may have additional rights as a consumer under local law that this Agreement cannot change.

LIABILITY LIMITATION; EXCLUSIVE REMEDIES NLPF  does not: (i) guarantee the accuracy, completeness, or usefulness of any information on the NLD  Site, or (ii) adopt, endorse or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by any party that appears on the NLD  Site. Under no circumstances will NLD  or its affiliates be responsible for any loss or damage resulting from your reliance on information or other content posted on the Site or transmitted to or by any Users.

Special Admonitions for International Use

As a consequence of the global nature of the Internet, you agree to comply with all local rules and laws regarding user conduct on the Internet and acceptable content. Specifically, and without limitation, you agree to comply with all applicable laws regarding obscene and indecent content and communications and those regarding the transmission of technical data exported from the United States or the country in which you reside.

For Equipment Services:

I hereby certify: 

(1) the information provided is true and correct, 

(2) you are hereby authorized to investigate all bank, credit, and trade references, and said references are hereby authorized to release any requested information to you or your nominee, 

(3) such authorization shall extend to obtaining a personal credit profile in considering this application and subsequently for the purposes of update, renewal or extension of such credit or additional credit and for reviewing or collecting the resulting account, 

(4) this information may be transmitted by us to you and by you to underwriter(s) for the purpose of granting me credit, either electronically or manually, and by submitting this application, I take full responsibility for transmission thereof, 

(5) I am over 18 years of age, 

(6) I acknowledge my rights under the Fair Credit Reporting Act, 

(7) I consent to receive direct mail, faxes, text messages, and e-mails sent by NLD  and its affiliates, and subsidiaries for the purposes of transmitting account updates, requests for information and notices, and 

(8) this request is for business and not for consumer purposes.

Text Messaging:

By providing my wireless phone number to NLDI agree and acknowledge that NLD may send text and multimedia messages to my wireless phone number for any purpose. I agree that these text or multimedia messages may be regarding the products and/or services that I have previously purchased and products and/or services that NLD may market to me. I acknowledge that this consent may be removed at my request but that until such consent is revoked, I may receive text or multimedia messages from NLD  to my wireless phone number.

The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status or age (provided the applicant has the capacity to enter into the binding contract); because all or part of the applicant’s income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. If for any reason your application for business credit is denied, you have the right to a written statement of the specific reasons for the denial. To obtain the statement, if we are the direct credit issuing source, please write to us, HERE. Funding amount and credit approval is subject to a full credit profile review.

Miscellaneous Clauses

Electronic Form. By accessing the Sites or Services, you consent to have this Agreement provided to you in electronic form. Please print a copy of this Agreement for your records.

Notices. If NLD  must send you additional information regarding the Sites or our Services, or in connection with this Agreement, you consent to receive this information electronically. NLD may provide the required information to you by email at any address you provided via the NLD  Site. Notices provided to you via email will be deemed given and received on the transmission date. You understand and agree that this Agreement and any notices given pursuant to this Agreement are enforceable in electronic format. NLD is not obligated to notify you if changes are made to this Agreement, so please check the terms regularly.

Entire Agreement. The Terms of Service (along with the Privacy Policy) constitute the entire agreement between you and NLD and govern your use of the NLD  Site, superseding any prior agreements between you and NLD  (including, but not limited to, any prior versions of the Terms of Service).
